Article 1 - PREAMBLE
The company QUINZE MAI (SASU WITH A CAPITAL OF 3,070,884 Euros - RCS Nanterre 302 382 858 – 42, rue Barbès - 92120 MONTROUGE) organizes the "TECH 4 HEALTH" event (hereinafter referred to as the "Event").
The website www.tech-4health.com provides access to content related to the Event (hereinafter referred to as the "Site").
Article 2 - PURPOSE
These General Terms of Use (“GTU”) aim to define the rules and conditions for the use of the services offered on the Site (hereinafter, the “Services”).
The present terms of use are accessible at any time via a direct link at the bottom of the page.
Article 3 - ACCESS TO THE SITE
Article 3.1 Access ConditionsAny internet user can browse and navigate freely on the Site (hereinafter referred to as “Users” or “You”).
Article 3.2 Legal CapacityWithout prejudice to specific provisions applicable to the processing of personal data of children, the User must have full legal capacity to agree to these General Terms. Any individual who does not have full legal capacity may only use the Services with the consent of their legal representative.
Article 4 - ACCEPTANCE OF THE GENERAL TERMS
The User agrees to read and comply with these GTU each time they log on to the Site.
Acceptance of the GTU is evidenced by checking a box in the registration form "I have read and accept the General Terms of Use". Once accepted, the GTU are fully binding on the User.
QUINZE MAI reserves the right to modify the GTU at any time and must inform the User at least fifteen (15) days before they take effect. The User is required to accept any modifications and/or any new version of the GTU to continue benefiting from the Services offered.
The latest updated version will always be accessible to any User on the Site via the link "General Terms of Use" or "GTU" located at the bottom of the homepage.
Any substantial change to these GTU will be notified to the User according to the conditions mentioned in Article 15.
Article 5 - DESCRIPTION OF THE SERVICES
QUINZE MAI provides Users with services without registration (5.1) and services conditioned by registration on the Site (5.2).
5.1. Services without registration- Browsing the Site (accessing the list of exhibitors, viewing the event program, the list of speakers, etc.)
- Watching videos and listening to podcasts
- Reading articles published on the Site
- Contacting QUINZE MAI via the "Contacts" tab for any request for information about our services, becoming an exhibitor, etc.
- Attending conferences and events offered by exhibitors or QUINZE MAI
- Accessing personalized content
- Participating and interacting with other participants
- Visiting stands and participating in activities
- Downloading documents from exhibitors or QUINZE MAI
- Receiving the event newsletter
- Receiving notifications and SMS related to the event
Article 6 - REGISTRATION
Article 6.1. Registration ProcessTo access certain Services (Article 5.2), the User must create a visitor space (hereinafter “Visitor Space”) by completing the form provided for this purpose and accepting the applicable contractual terms.
The User must provide all mandatory information indicated by an asterisk. Any incomplete registration will not be validated. They may also, if desired, provide optional information that may appear on this form, which will allow QUINZE MAI to personalize the products/services offered.
In accordance with regulations related to personal data, we commit to collecting the minimum necessary data for the purposes pursued. For more information on our data processing policy, please refer to the "Information Notice on Personal Data Protection" available on the Site.
The User guarantees that all the information they provide in the registration form is accurate, up to date, and sincere.
The User undertakes to update this information in the event of changes so that it always meets the aforementioned criteria.
The User is informed and accepts that the information entered for the creation or update of their Account serves as proof of their identity. The information entered by the User binds them upon validation.
Notifications will be sent to the email address indicated in the User's profile. The User must therefore ensure the validity of their email address.
The User can access their Visitor Space at any time from the confirmation email they received.
Article 6.2. Connection ModalitiesThe User agrees to use the Service personally and not allow any third party to use it in their place or on their behalf, except at their own risk.
The User is responsible for maintaining the confidentiality of their Login Information, which is strictly personal. In case of loss, theft, or any fraudulent use of their Login Information, the User must immediately inform QUINZE MAI.
Any connection or data transmission made using the Login Information will be deemed to have been made by the User and under their exclusive responsibility. Consequently, QUINZE MAI cannot be held responsible for the fraudulent use of the User's Login Information by a third party.
Article 6.3. Unsubscription ModalitiesThe User has the option to unsubscribe from the newsletter and/or delete their Visitor Space.
The steps to delete their account are as follows:
- You can unsubscribe or object to receiving commercial prospecting messages from QUINZE MAI at any time. Simply click on the "unsubscribe" link in any email or communication sent by QUINZE MAI.
- Or request account deletion by emailing: data@15-mai.com. The unsubscription will be effective after receipt of the request by QUINZE MAI, which will deactivate the account as soon as possible.
In case of deletion, the User's contributions via a blog or comments made will be anonymized but still readable by internet users and/or other Users.
For complete deletion of all personal data, we recommend that the User refer to the procedure described in the "Information Notice on Personal Data Protection".
Furthermore, QUINZE MAI may decide to terminate the Services. Users will be duly informed by email at least one month before the cessation of Services.
Article 7 - INTELLECTUAL PROPERTY
The systems, software, structures, infrastructures, databases, and content of any kind (texts, images, visuals, music, logos, brands, databases, etc.) used by QUINZE MAI on the Site are protected by all applicable intellectual property or database producer rights. Any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally, any act of reproduction, representation, dissemination, and use of any of these elements, in whole or in part, without the authorization of QUINZE MAI, is strictly prohibited and may lead to legal proceedings.
Article 8 - TERMS OF USE OF SERVICES
Without prejudice to the other obligations set out herein, the User undertakes to comply with the following obligations.
The User undertakes to use the Services in compliance with current laws and regulations and not to infringe the rights of third parties or public order. QUINZE MAI's liability cannot be engaged in this respect, and any User who violates this obligation agrees to indemnify it.
The User acknowledges being aware of the characteristics and constraints, particularly technical, of the Services.
The User is solely responsible for their use of the Services. It is their responsibility to use the Services with appropriate caution and judgment. The User also undertakes, in their interactions, to observe the usual rules of politeness and courtesy.
The User agrees to use the Services strictly for personal purposes.
The User undertakes to provide all necessary information for the proper performance of the Services. More generally, the User undertakes to actively cooperate with QUINZE MAI.
The User agrees not to infringe public order, good morals, or the rights of third parties, not to violate any legal or regulatory provision, and more generally, not to do anything that could engage QUINZE MAI's civil or criminal liability.
The User is informed and accepts that:
- The implementation of the Services requires them to be physically present at the Event, and the quality of the Services directly depends on their attendance, for which they are solely responsible;
- Using certain features of the Site requires them to have a personal account on certain social networks, for which they are solely responsible.
When aware, QUINZE MAI may remove any User publication made as part of the use of the Services that contains defamatory, offensive, racist, homophobic, etc., remarks.
The User guarantees QUINZE MAI against all complaints, claims, actions, and/or demands it may suffer due to the User's violation of any of their obligations or guarantees under these general terms.
The User agrees to compensate QUINZE MAI for any damage suffered and to pay all costs, charges, and/or sentences it may have to bear as a result.
Article 9 - CONFIDENTIALITY
Information disclosed to the User due to their use of the Services falls under know-how or intellectual property rights and is considered confidential.
The User undertakes, for themselves and their providers, to take all necessary measures to ensure the secrecy, confidentiality, and security of the information they may have become aware of while using the Services and not to disclose it to anyone, either during the use of the Services or during the following three (3) years. They undertake, at the end of their use of the Services, to destroy all copies of information media in their possession.
The User ensures compliance with these commitments by their employees, providers, or subcontractors.
Article 10 - PROHIBITED CONDUCT
It is strictly forbidden to use the Services for the following purposes:
- Engaging in illegal, fraudulent activities or activities that harm the rights or safety of third parties,
- Disturbing public order or violating current laws and regulations,
- Intruding into QUINZE MAI’s or third-party computer systems or any activity that could harm, control, interfere with, or intercept any part of QUINZE MAI’s or a third-party system, and/or violate its integrity or security,
- Sending unsolicited emails and/or commercial prospecting or solicitation,
- Manipulating to improve a third-party site's ranking,
- Crawling or scraping the Site content by robots or any other means to copy data stored on QUINZE MAI’s or its service providers' servers,
- Assisting or encouraging, in any form or manner, one or more of the acts and activities described above,
- And more generally, any practice diverting the Services from their intended purposes.
It is strictly forbidden for Users to copy and/or divert for their purposes or those of third parties the concept, technologies, data, or any other element of the Site.
The following are also strictly prohibited: (i) any behavior likely to interrupt, suspend, slow down, or prevent the continuity of the Services, (ii) any intrusions or attempts at intrusions into QUINZE MAI's systems, (iii) any misuse of the Site's system resources, (iv) any actions that place a disproportionate load on its infrastructure, (v) any breaches of security and authentication measures, (vi) any actions likely to damage the financial, commercial, or moral rights and interests of QUINZE MAI or the Site's users, and finally, (vii) any failure to comply with these general terms.
It is strictly forbidden to monetize, sell, or grant all or part of access to the Services or the Site, as well as the information hosted and/or shared there.
Article 11 - BREACHES
In the event of a breach of any of the provisions of these general terms or, more generally, of a violation of current laws and regulations by a User, QUINZE MAI reserves the right to take any appropriate measures, including:
- Suspending, deleting, or preventing the User, author of the breach or violation, or participant, from accessing the Services,
- Notifying any relevant authority,
- Initiating any legal action deemed necessary.
Article 12 - LIMITATION OF LIABILITY AND WARRANTIES
QUINZE MAI's liability is limited to providing the means described herein and facilitating contact between Users and exhibitors at the Event, with QUINZE MAI only having an obligation of means, not an obligation of result, which Users expressly acknowledge and accept.
QUINZE MAI undertakes to conduct regular checks to verify the functioning and accessibility of the Site. To this end, QUINZE MAI reserves the right to temporarily interrupt access to the Site for maintenance reasons.
QUINZE MAI shall not be held liable for any temporary difficulties or impossibilities of access to the Site resulting from external circumstances, force majeure, or disruptions in telecommunications networks.
QUINZE MAI does not guarantee (i) that the Services, subject to continuous improvement efforts, will be entirely free of errors, defects, or flaws, (ii) that the Services, being standard and not tailored to the specific needs of an individual User, will meet their specific needs and expectations.
In no case shall QUINZE MAI be held liable for inaccuracies in information provided by exhibitors at the Event, inability to use the Services, loss of business or profit, data loss, or any indirect damages related to accessing the Site or using the Services. Users must prove that any fault by QUINZE MAI is the direct cause of their harm.
Article 13 - LINKS AND THIRD-PARTY SITES
QUINZE MAI cannot be held responsible for the technical availability of websites or mobile applications operated by third parties (including any potential partners) that the User accesses via the Site.
QUINZE MAI assumes no responsibility for the content, advertisements, products, and/or services available on third-party sites and mobile applications, which are governed by their own terms of use.
QUINZE MAI is also not responsible for transactions between the User and any advertiser, professional, or merchant (including any potential partners) to whom the User is directed via the Site and shall not be considered a party to any disputes between the User and a third party, such as those relating to the delivery of products and/or services or obligations and warranties incumbent on the latter.
Article 14 - MODIFICATION OF THE GTU
QUINZE MAI reserves the right to modify, at any time, all or part of these GTU. The User will be informed of any substantial changes.
The User who refuses to accept the modified GTU cannot use the Services.
The User who continues to use the Services is deemed to have accepted the modified GTU, which will then be fully enforceable against them.
Article 15 - APPLICABLE LAW
These GTU are governed by French law.
If the user is a merchant, any dispute arising from these GTU shall be under the exclusive jurisdiction of the courts of Paris.
